Welcome to erpSYMS, a cloud-based Enterprise Resource Planning (ERP) platform provided by SYMS Company (Pty) Ltd. These Terms and Conditions (“Terms”) govern your use of the erpSYMS website, software, and services (collectively, the “Service”).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Use of Service

• You must be at least 18 years old to use erpSYMS.

• You agree to use the platform only for lawful business activities.

• Unauthorized access, duplication, reverse engineering, or misuse of the system is strictly prohibited.

3. User Accounts

• To access the platform, you must register and create a secure user account.

• You are responsible for maintaining the confidentiality of your login credentials.

• All actions taken under your account are your responsibility.

4. Subion and Payment

• erpSYMS is offered on a subion basis. Pricing is outlined on the platform or in custom agreements.

• Payments are due as per the selected plan or signed agreement. Non-payment may lead to suspension or termination of access.

• All fees are exclusive of applicable taxes unless stated otherwise.

5. Data Privacy and Security

• We prioritize your data privacy in compliance with the Protection of Personal Information Act (POPIA) and GDPR.

• Your data remains your intellectual property. We will not sell or misuse it.

• We implement industry-standard security measures to protect your information.

6. Intellectual Property

• All content, code, logos, and materials on erpSYMS are the intellectual property of SYMS Company (Pty) Ltd.

• You may not copy, reproduce, or modify any part of the platform without our written consent.

7. Limitation of Liability

• erpSYMS is provided “as is.” We make no warranties regarding uninterrupted use or fitness for a particular purpose.

• SYMS Company shall not be liable for any loss of data, revenue, or indirect damages arising from use of the Service.

8. Termination

• We may suspend or terminate access to erpSYMS for breach of these Terms or any illegal activity.

• Users may terminate their subion with written notice as per the subion agreement terms.

9. Updates and Modifications

• SYMS Company reserves the right to update or modify these Terms at any time.

• Continued use of the Service after changes implies acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Gauteng Province.
